Summary

DLA Piper analyzes China's AI Safety Governance Framework released in September 2024, which establishes principles and mechanisms for managing AI safety risks including technical safety standards, content controls, and oversight requirements for AI developers and deployers operating in China. The framework reflects China's broader regulatory approach to AI, emphasizing state oversight alongside industry responsibility.

Key Points

  • China's framework addresses AI safety across multiple dimensions including algorithmic risks, data security, and content governance for AI systems.
  • The framework places obligations on AI developers and deployers to conduct safety assessments and implement risk mitigation measures.
  • Content control and ideological alignment requirements reflect China's distinctive approach to AI governance, distinct from Western safety frameworks.
  • The framework signals China's intent to position itself as a global standard-setter in AI safety alongside its domestic regulatory ambitions.
  • International AI developers operating in China must navigate these requirements alongside other regulations like the Generative AI Measures.

China releases AI safety governance framework

Written by:Danny TobeyAshley CarrCarolyn BiggSean FultonAmanda Ge

On September 9, 2024, China’s National Technical Committee 260 on Cybersecurity released the first version of its AI Safety Governance Framework (the Framework), which was formulated to implement the Global AI Governance Initiative. The Framework acknowledges that Artificial Intelligence (AI) is “a new area of human development” that “presents significant opportunities to the world while posing various risks and challenges.” Aimed at addressing the safety, ethics, and social implications of AI, the Framework is designed around a “people-centered approach” and the “principle of developing AI for good.”

The Framework outlines principles for AI safety governance, classifies anticipated risks related to AI, identifies technological measures to mitigate those risks, and provides governance measures and safety guidelines. Our alert provides a detailed summary of the Framework.

Principles and framework for AI safety governance

The Framework prioritizes addressing ethical concerns in AI development, including safety, transparency, and accountability, and seeks to develop AI in ways that are inclusive and equitable, avoiding biased or discriminatory outcomes. It outlines control measures to address different types of AI safety risk through technological and managerial strategies, emphasizing the importance of continuously updating control measures and refining the governance framework.

Some of the identified principles include:

Prioritizing the innovative development of AI

Establishing governance mechanisms that engage all stakeholders, ensuring coordinating efforts and collaboration

Creating a whole process, including all elements of the governance chain

Fostering safe, reliable, equitable, and transparent AI, and

Protecting the rights and interests of citizens and organizations such that AI technology benefits humanity.
