History and Background

General History of Industry Self-Regulation

Industry self-regulation has existed in recognizable form since at least the late nineteenth century. Criticism and Concerns

The most fundamental criticism of AI industry self-regulation is structural: the entities setting and enforcing standards are the same entities whose commercial success depends on deploying AI systems widely and quickly. This creates systematic pressure to define safety standards narrowly and apply them permissively.11 Community discussions on LessWrong and the EA Forum reflect sustained skepticism: concerns include that AI firms issuing safety policy papers creates a conflict where profit-driven actors define acceptable risks, producing vague opt-in guardrails that prioritize market growth over long-term safety.12

A second structural concern is power concentration. Several commentators have noted that self-regulatory proposals — even those genuinely motivated by safety — position the proposing organizations as arbiters of model deployment, potentially entrenching incumbent advantage and creating barriers to entry for smaller competitors.12 This concern applies with particular force to the FMF, whose membership is limited to the most capable developers.

Third, antitrust constraints limit what consortia can actually do. Self-regulatory associations cannot legally impose certain competitive restrictions on members; this constrains the enforcement mechanisms available and may explain why sanctions are absent from every major AI consortium reviewed here.13

Finally, the 2025 shift in U.S. AI policy — with the Trump administration rescinding prior commitments to AI safety institutes and prioritizing domestic innovation — has weakened the government backstop that makes self-regulation credible.
